Privacy Policy


This policy ("Privacy Policy") shall come into effect from 01.01.2019.

 This Privacy Policy has been prepared in accordance with Articles 13 and 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ("GDPR"). The purpose of this Privacy Policy is to inform you about the processing of your personal data, the purposes of such processing, the measures and safeguards for the protection of your personal data, as well as your rights under the GDPR and the laws of the European Union and the Republic of Bulgaria.

The controller within the meaning of the GDPR is FUELAB Ltd (hereinafter referred to as "FUELAB" or "Controller"), a company validly incorporated and existing under the laws of the Republic of Bulgaria, registered in the Commercial Register under UIC 208368579, with its registered office and registered address in the city of Sofia, ul. "Stoyan Kambarev" № 6, p.k. 1700 to which address you may send your requests, inquiries and/or comments regarding the processing of your personal data, to the attention of Cathy Traicheva.

FUELAB is committed to ensuring the protection of your personal data. If we ask you to provide certain personally identifiable information, you can be assured that it will only be used in accordance with this Privacy Policy.

 

2. Purposes and grounds for processing personal data

FUELAB processes personal data on the following legal grounds:
◦ consent of the data subjects. Where we process data on the basis of consent, personal data shall only be processed if the individual has freely, specifically, informed and unambiguously consented to the processing;
◦ the processing is necessary for the performance of a contract to which Re Brand is a party or to take steps at the request of the data subject prior to entering into a contract;
◦ where the processing is necessary for compliance with a legal obligation to which applies to FUELAB;
◦ on the basis of a legitimate interest of FUELAB in processing the information.

 

FUELAB processes personal data for the purposes of:
◦ the provision of professional services under a contract;
◦ the performance of FUELAB's legal obligations under applicable Bulgarian labour, social security and tax legislation;
◦ Investigating and/or defending the rights and interests of FUELAB in potential claims and other legal proceedings;
◦ invoicing for services rendered by FUELAB and addressing any disputes regarding fees due for services rendered;
◦ communication, including by email, necessary in connection with the provision of services, responding to inquiries and/or notifying changes in the services provided.
◦ Providing you with information about other services we perform which may be of interest to you, if you have expressly consented to this;
◦ recruitment;
◦ protecting the Company's property, goods, equipment, employees and customers;


Legal basis for processing:

We process your personal data on the following legal grounds:


-Execution of a contract (Art. 6 (1) (b) GDPR) - for the execution and delivery of orders placed by you;

-Legal obligation (Art. 6, par. 1, b, '''c''' GDPR) -to fulfil accounting and tax requirements;

-Consent (Art. 6, par. 1, b, ''a'' GDPR) -for sending marketing and advertising messages;

-Legal interest (Art. 6, par. 1, b. '''f''' GDPR) - to improve the security and efficiency of our services. 


Data processing is carried out for the specific and precise purposes defined by law, lawfully and in good faith and may not be further processed in a manner incompatible with these purposes.

 

3. Communication and direct marketing

When you send enquiries via the enquiry form at www.fuelabhydration.com you are required to provide an electronic address (e-mail). We may use your e-mail address for direct marketing purposes and so send you information about our products.

 

You may unsubscribe at any time and absolutely free of charge from any communications, notifications or emails sent by www.fuelabhydration.com All emails we send will contain a link to unsubscribe directly.

 

Unsubscribing from communication with us will be interpreted as an objection to the processing of your personal data as far as direct marketing is concerned.

 

We do not provide/sell your communication details to third parties and by sending enquiries to info@fuelabhydration.com you will only receive information from www.fuelabhydration.com and no one else.

 

4. Information you provide to www.fuelabhydration.com

When you use the enquiry form on www.fuelabhydration.com, you provide us with certain personal data such as your first and last name, email address and telephone number. Filling in your first name, last name and e-mail address is mandatory and we cannot process your enquiry without these details. The information you provide to www.fuelabhydration.com will not be publicly available and cannot be found by search engines. Messages you send to FUELAB via the enquiry form contain free text entered by you. It is up to you to decide whether and what data relating to you to include.

 

FUELAB will process the information you provide via the enquiry form on the website only for the purposes of processing and responding to your enquiry and complying with any legal obligations that apply to FUELAB. The information will be retained for a period of no more than 2 weeks after the completion of the specific enquiry, unless there are other grounds for retaining the personal data.

  

5. Information we collect about you

Our servers automatically record information created by you when you use our services ("Visitor Information"). Visit Information may include data such as your IP address, browser type, operating system, referring page, pages visited, location, mobile device, search terms and cookie information. We receive Visitor Information when you use our services, for example, when you visit our website or interact with our email notifications. We use Visitor Information to provide, measure, personalize and improve our services. Visit Information will be retained for 6 months. Site behaviour data via cookies (see Cookie Policy).

 

6. Disclosure of personal data to third parties

We may engage suppliers to provide certain services to us (e.g. accountants, IT specialists, auditors, etc.). These providers have the capacity of a processor of personal data. We may share your PII with such service providers, subject to confidentiality obligations consistent with the Privacy Policy and provided that they use your PII only on our behalf and in accordance with our instructions.

 

We do not disclose personal data to third parties and recipients unless there is a lawful basis for obtaining the data or the data is not publicly available due to its inclusion in a public register.

 

Outside the case of public availability of data included in a public register, recipients of data may be, as the case may be:
◦ Public authorities and bodies entrusted with public functions within the scope of their powers (NRA, NSSI, Ministry of the Interior, etc.);
◦ Banks for the needs of payments made;
◦ Courier companies and postal operators - for the needs of making deliveries and correspondence with natural persons-data subjects


In certain cases we provide your personal data to the following categories of recipients:

-Courier companies - for making deliveries;

-Payment processors - to process payments;

-Hosting providers - for site maintenance;

-Accounting and legal consultants - where necessary to comply with legal or contractual obligations;


Transfer outside the EU (Article 13(1)(f))


We do not transfer processed personal data to third countries outside the European Economic Area. In the event that this becomes necessary (e.g. when using cloud services), we will take all measures provided for in the GDPR, including entering into standard contractual clauses approved by the European Commission.


7. Retention period for personal data

We will retain your personal data no longer than is necessary to fulfil the purposes listed in this Privacy Policy and/or as required by applicable law, including compliance with applicable legal provisions regarding minimum retention periods and/or as necessary to exercise our legitimate rights (and those of third parties). E.g., personal data that is collected through the site's enquiry form is retained for a period of 2 weeks after the completion of work on the specific enquiry. Where we process your personal data on the basis of consent, that personal data will only be processed for the period for which your consent was provided, unless you withdraw or restrict your consent before the end of that period. In these cases, we will cease processing the personal data concerned for the purposes concerned, subject to any legal obligations regarding the processing of personal data and/or obligations arising from the need to process that personal data in order to exercise our legitimate rights.


Storage periods:


-Data relating to the execution of orders - 5 years after the completion of the order (in accordance with Article 38 of the Accounting Act);

-Data for marketing purposes - until withdrawal of consent;

-Data received via contact forms - until 12 months after the end of the correspondence;

-Data collected via cookies - in accordance with the terms set out in the Cookie Policy.


 

8. Your rights

You have the right to request access to and receive information about the personal data we hold about you, to request that your information be updated or corrected, and to request that information be blocked or deleted if any of the conditions of Article 17 of the GDPR apply.

 

In addition, you also have the right to request restriction of processing, object to processing or withdraw your consent to processing at any time.

 

Please note that you may not be able to benefit from all functions of the website or our services if you request erasure of your information, object or withdraw your consent to the processing of your information.

 

You have the right to data portability if the prerequisites of Article 20 GDPR are met, and we will also provide you with the information we hold about you on request. You have the right to receive the personal data provided by you in structured, commonly used and machine-readable format, and to request its transfer to another controller where this is technically possible.

 

Last but not least, you have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.

 

In addition to the foregoing, you may exercise your rights under this paragraph 3 by sending a written request to FUELAB at the address or e-mail address set out in paragraph 1 above.

 

Automated decision-making:


We do not carry out automated decision-making, including profiling, that has legal consequences for you or affects you in a significant way.

9. Right to complain to the Data Protection Commission and to the courts

If you believe that your rights have been violated, you have the right to file a complaint with the Data Protection Commission or the competent administrative court.

10. Changes to the privacy policy

We may revise this Privacy Policy from time to time. The most current version of the Policy will govern our use of your information and can always be found at https://fuelabhydration.com. By continuing to use our site and services after these changes become effective, you agree to be bound by the revised Privacy Policy.
